                                                           GOLF COURSE ACCESS AGREEMENT
  



This agreement is made this _____________day of _________, 200__ between Country Club of Roswell (“Club”) and ______________________________ a Willow Springs Subdivision homeowner (“homeowner”). 

Whereas homeowner warrants that they are the legal owner and hold legal title to the property at ________________________________, Roswell, Georgia 30076.  

Whereas homeowner desires to have access to the Country Club of Roswell golf course cart path network in order to accommodate work to be performed on their property.  

Whereas homeowner will use __________________________(“Contractor”) whose principle business address is ___________________________, ______________,  _______________________.  

Whereas homeowner and contractor desire to perform work as described below:

Whereas homeowner desires access (“access period”)during the hours of _________ and __________ on ___________, _____. 200__ to perform the work as described above.   Now therefore as an inducement to provide access, homeowner and contractor agree to joint and several responsibilities for any and all damages to club property incurred during the access period.   Homeowner and contractor further agree to make timely and complete repairs to club property caused by the homeowner or the homeowner’s contractor at their expense for any damage resulting from the granting of access by the Club.  Timely and complete repairs means within 7 calendar days following the access period and to a degree consistent with the condition before access was granted.  All repairs are subject to satisfactory approval from the club.  

Homeowner further agrees to provide the club with a copy of the declaration page of their homeowner’s insurance policy as well as a copy of the declaration page of their contractor’s general liability policy.  

If the homeowner is not a club member the homeowner agrees to provide a conditionally refundable deposit to the club in the amount of ________.  The deposit will be refunded to the homeowner when all satisfactory repairs and cleanup work to golf course property have been completed.  In the event that the homeowner or contractor do not complete repairs to club property in an acceptable and timely fashion, the club will use the deposit to make repairs, itemize those repairs and return any remaining deposit if any to the homeowner.  This does not alleviate the homeowner or contractor from the responsibility to make repairs that may be over and above the amount of the deposit and both homeowner and contractor agree to make additional payments as necessary within 7 days of being billed by the club.  

If necessary, homeowner agrees to timely file a claim under their homeowner’s insurance policy to cover all costs of repair.   If necessary, contractor agrees to timely file a claim under their general liability policy to cover all costs of repair.   

By affixing signatures below, homeowner, contractor and club agree to be bound by the above agreement.
